District Attorney’s Office Considering Charges After Deadly Motorcycle Accident

Deadly Motorcycle Accident

7/10/2019 Motorcycle Accidents John Whitfield

The District Attorney’s Office in Davidson County is considering filing charges after a motorcycle accident turned deadly. While law enforcement is still investigating the crash, they believe the driver’s failure to yield to the motorcycle could have been a contributing factor. The devastating accident is an important reminder that it only takes one moment of carelessness to end a life when you are behind the wheel.

James Walker was riding his motorcycle down East Old Hickory Boulevard in Madison when he was involved in a collision with another vehicle. The vehicle was turning left into a market when it hit Walker and his motorcycle. Although Walker was wearing a helmet, he later succumbed to fatal injuries at the hospital.

Failure To Yield To Motorcycles

Failing to yield to motorcycles when turning is one of the most common causes of motorcycle accidents. Some of the time, drivers fail to look for motorcycles before turning; and, other times drivers incorrectly assume the size of their vehicles give them the right-of-way. It’s a sad fact that many drivers aren’t as careful as they need to be when sharing the roads with motorcycles. Drivers often only haphazardly check for motorcycles and the consequences can be fatal.

Motorcycles do not offer the same protection as passenger vehicles, but this doesn’t mean people who ride motorcycles have any less right to the road or that it is okay for reckless drivers to cause motorcycle accidents. Because injuries associated with motorcycle accidents are severe, it’s important that drivers share the road and look out for motorcycles.

Getting Compensation After A Motorcycle Accident

While criminal charges can punish an individual for causing a motorcycle accident, the criminal justice system is not designed to financially compensate injury and death victims and their families. In order for motorcycle crash victims to receive the compensation they need, they must file a personal injury lawsuit in civil court. While no amount of money can undo the mental and emotional trauma of a life-changing injury or wrongful death, compensation can cover the cost of emergency medical treatment, lost wages, and ongoing medical care, among many other expenses.
